    Comments to the Circular 1/2016 which analyzes the criminal liability of legal persons

    WITH CRIMINAL CODE REFORM PLANS COMPLIANCE OF COMPANIES BECOME DEFENSE TO CRIMINAL LIABILITY LEGAL PERSONS 

    The Attorney General has issued Circular 1/2016 which analyzes the criminal liability of legal persons under the Penal Code which came into force last July (Organic Law 1/2015). 

    With this document, the Attorney General instructs prosecutors to assess the effectiveness of compliance plans and compliance in companies. After the reform, such plans are set up as a defense to criminal liability of legal persons and, therefore, it is important that companies know what will be the guidelines that the prosecution will take into account to apply or not the defense . 

    The Circular states that without prejudice to take into account the very different circumstances in each case, should observe the following guidelines general to assess the effectiveness of organizational models and management: The regulation of organization and management models should be interpreted so that the regime of criminal responsibility of the legal person no content is empty and is in practice impossible appreciation.   Read full article here.
