No tax offense in donations to PP because until 2012 the parties lacked criminal responsibility as a legal entity
The Tax Office has prepared a report submitted to the National Court Judge Pablo Ruz, which is estimated at 220,167 euros fee that would have defrauded the PP in the 2008 Corporate Tax pretending party funds were not exempt from taxation. However insists that no crime , since the donations were not subject to tax themselves to have been used for party purposes , as could be the renovation at the party headquarters .
The Ruz judge asked the Treasury to calculate this value in case investigating the alleged PP Box B , although the technicians had already argued that donations were exempt from taxation. Moreover, even if they had had to do it , neither could consider that the PP had committed tax fraud, and that political parties lacked criminal responsibility as a legal entity until 2012.
